Terms and conditions
Last updated on October 14, 2026
By using UserLimit, you ("User") agree to these Terms and Conditions ("Terms"). UserLimit is operated by Useful Collective s.r.o. ("Company"). Our website, load testing application, and related features and infrastructure are referred to as the "Service".
1. Business Users Only
The Service is intended for business users acting in a professional or commercial capacity, not consumers. If you use the Service on behalf of a business, you confirm that you have authority to bind it to these Terms. Any mandatory consumer rights that nonetheless apply remain unaffected.
2. Accounts and Communication
Users must provide accurate account information, keep their contact details current, and protect their login credentials and access tokens. Users are responsible for activity they authorize through their account, including scheduled tests and connected integrations, and must promptly report suspected unauthorized access. The Company may contact Users by email or through the Service.
3. Authorized and Prohibited Use
Users may test systems they own or have permission to test, including client systems. Users must obtain all necessary authorizations for the scope and volume of testing, including any permissions required by hosting providers and third-party services affected by a test. Domain verification does not replace those authorizations. The Company may request evidence of permission and restrict or stop tests.
Users must not:
- Conduct unauthorized testing, denial-of-service attacks, or other unlawful or malicious activity;
- Use the Service for scraping, spam, credential attacks, or purposes unrelated to authorized testing;
- Bypass verification, security controls, usage limits, or billing, or interfere with the Service or other users;
- Infringe another person's rights or violate applicable laws or provider policies.
4. Testing Risks
Tests generate real traffic and may slow down or interrupt systems, modify or delete data, trigger transactions or messages, and incur third-party charges. Users are responsible for selecting targets, scenarios, test data, load levels, and schedules, and for taking appropriate precautions, including backups and safe test accounts. These responsibilities also apply to scenario validation.
Stopping a test may prevent additional sessions from starting while sessions already running finish their actions. Error thresholds and other controls do not guarantee that damage or additional charges will be prevented. A test that reveals errors or failure in a target system is not, for that reason alone, a failure to provide the Service.
5. User Data and Intellectual Property
Users retain their rights in their scenarios, test inputs, and results. Users grant the Company permission to process that data only as needed to provide and support the Service, maintain security, enforce these Terms, and comply with law. The Company and its licensors retain all rights in the Service itself.
Users must not include personal data in test scenarios or inputs and must ensure they have the right to submit and use all test data. Our Privacy Policy explains how personal data is handled. This restriction does not exclude any data protection obligations that apply to personal data actually processed.
The Company will treat non-public scenarios, test inputs, and results as confidential, with access limited to personnel and service providers who need it for the purposes above and are subject to confidentiality obligations, or as required by law. Users control any sharing through integrations they enable.
6. Payment and Billing
Users agree to pay the fees and applicable taxes disclosed at purchase, including any usage charges. Allowances, billing periods, and other purchase conditions are shown in the Service or at checkout. Subscriptions renew automatically for the stated billing period unless canceled before renewal. Cancellation takes effect at the end of the current paid period.
Usage is paid for in advance and is drawn from included or purchased hours as resources are consumed, including when the target system returns errors or becomes unavailable, or a run stops early. Additional hours are charged to the payment method saved at checkout when the user buys them, or automatically when the user has turned on auto top-up and their hours fall below the threshold they set. Paddle.com Market Limited (Paddle) acts as merchant of record and reseller for purchases. The terms presented at checkout also apply.
7. Refunds
Fees are non-refundable unless required by law or the applicable purchase or payment-provider terms, including Paddle's buyer terms. The Company may consider refunds or credits for unused purchases or problems with the Service within its control. Please contact support with the relevant details.
8. Changes
The Company may change the Service, these Terms, and pricing at any time to reflect changes to its offering, costs, security needs, or legal requirements. Changes will be communicated by email or through the Service and apply from the stated effective date. Where required by law, Users will receive advance notice and the right to reject changes and terminate. Subject to those rights, continued use after a change takes effect constitutes acceptance of the revised Terms. Price changes do not alter charges already incurred.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available". To the fullest extent permitted by law, the Company disclaims warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. The Company does not guarantee uninterrupted or error-free operation, any particular test capacity, or that results will predict production performance or meet the User's requirements.
10. Limitation of Liability
To the fullest extent permitted by law, the Company is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, business interruption, or loss of data resulting from use of the Service. The Company's total liability arising from or relating to the Service or these Terms is limited to the fees paid by the User for the Service in the six (6) months preceding the event giving rise to the claim, including fees paid through the merchant of record.
Nothing in these Terms excludes or limits liability for intentional misconduct, gross negligence, harm to an individual's natural rights, or any other liability that cannot lawfully be excluded or limited, including protections applicable to a weaker party.
11. Indemnity
Users agree to defend and indemnify the Company against third-party claims, damages, and reasonable legal costs arising from the User's unauthorized testing, unlawful test data, or other breach of these Terms or another person's rights. This obligation is not subject to a monetary cap and does not cover claims to the extent caused by the Company's own breach or misconduct.
The Company will promptly notify the User of a claim and reasonably cooperate in its defense at the User's expense. The User may control the defense but may not agree to a settlement that imposes obligations on the Company or fails to release it from liability without the Company's consent.
12. Suspension and Termination
The Company may suspend or terminate access to the Service, including immediately where necessary to address suspected abuse, security risks, non-payment, a breach of these Terms, or legal requirements. Users may cancel their subscription or request account deletion through their account settings. Before requesting account deletion, cancel your subscription and disable scheduled tests. Termination does not remove payment obligations already incurred or rights required by law, including applicable rights to retrieve or export data. Personal data is retained in accordance with the Privacy Policy.
13. Governing Law
These Terms are governed by the laws of the Czech Republic. Disputes arising from these Terms or the Service are subject to the exclusive jurisdiction of the competent courts in Prague, Czech Republic, except where mandatory law requires otherwise.
14. General
If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. Users may not transfer these Terms without the Company's consent; the Company may transfer them in connection with a merger, acquisition, or sale of its business, subject to applicable law. Provisions concerning accrued payments, intellectual property, confidentiality, liability, indemnity, and disputes survive termination as applicable.
